By creating an account or using Lenspost, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Lenspost is a platform that enables photographers to discover and participate in photography competitions, and enables organizers to create and manage photography competitions. Our Service includes:

• Browsing and entering photography competitions
• Creating and managing photography portfolios
• Organizing and hosting photography competitions
• Payment processing for competition entry fees and prizes
• Communication tools between participants and organizers
• Judging and scoring systems for competitions

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem appropriate. You may also delete your account at any time through your account settings.

4. User Content and Intellectual Property

4.1 Your Content

You retain all ownership rights to the photographs and other content you submit to Lenspost ("User Content"). By submitting User Content, you grant Lenspost a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and promoting the Service.

4.2 Content Representations

By submitting User Content, you represent and warrant that:

• You are the creator and owner of the content, or have obtained all necessary permissions
• Your content does not infringe any third-party intellectual property rights
• Your content does not violate any applicable laws or regulations
• Your content does not contain any defamatory, obscene, or harmful material
• If your photos include identifiable individuals, you have obtained their consent

4.3 Competition-Specific Rights

Individual competitions may have additional terms regarding the use of submitted photographs. By entering a competition, you agree to the specific rules and rights outlined by the competition organizer. Always review competition-specific terms before submitting.

5. Competition Rules

5.1 For Participants

• Submit only original work that you have created
• Follow all competition-specific rules and deadlines
• Do not submit the same photograph to multiple competitions unless explicitly allowed
• Accept judging decisions as final
• Provide accurate information about your photographs when required

5.2 For Organizers

• Provide clear, fair, and complete competition rules
• Honor all stated prizes and awards
• Conduct fair and unbiased judging processes
• Communicate promptly with participants regarding results and prizes
• Comply with all applicable laws regarding competitions and prizes

6. Payments and Fees

6.1 Entry Fees

Some competitions may require entry fees. The final total and any applicable tax treatment are shown before payment. Joyixir OÜ, trading as Lenspost, is the merchant for platform-collected entry fees; Stripe securely processes the payment and issues the payment receipt.

6.2 Refunds

Each competition shows its refund policy before checkout. You can request an eligible refund from your Lenspost payment record. The request, decision, refund status and confirmation remain visible in your account. Approved refunds are returned through Stripe to the original payment method; bank processing time can vary.

6.3 Prize Distribution

Prize distribution is the responsibility of competition organizers. Lenspost facilitates payment processing but is not responsible for prize fulfillment. Winners may be required to provide tax information for prizes above certain thresholds.

7. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Infringe on others' intellectual property rights
• Submit false, misleading, or fraudulent information
• Manipulate voting or judging processes
• Create multiple accounts to gain unfair advantages
• Harass, abuse, or harm other users
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the Service
• Use the Service for any illegal or unauthorized purpose
• Collect or harvest user data without consent

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OF COMPETITION ORGANIZERS OR OTHER USERS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Lenspost SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Lenspost and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitute acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by the laws of Estonia, without regard to conflict-of-law principles. Mandatory consumer protections in your country continue to apply where the law requires them.
